Terms
These Terms of Service ("Terms") govern your use of Dudel Draw (the "App"), published by Silly Little Apps LLC ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Description of the App:
Dudel Draw invites you to draw on a new shape each day (the "Daily Challenge"), track a daily streak and unlock streak-milestone app icons, and optionally subscribe to Dudel Club for additional features, including saving drawings to a personal Sketchbook, creating a custom Avatar, Streak Freeze protection, and cross-device sync of your Daily Challenge drawing.
Our Privacy Policy describes what information we collect through these features and how we use it, and is incorporated into these Terms by reference. By using the App, you agree to both these Terms and the Privacy Policy.

2. Eligibility
The App's locally available features (the Daily Challenge canvas without an account, local streak tracking, streak-milestone app icons, and the widget) may be used without creating an account. You must be at least 13 years old to create an account, or to use any feature that involves the collection or storage of account-associated information, including Sketchbook, Avatar, cross-device sync, and Dudel Club.
Before you create an account, we ask for your birth month and year. This information is used only to confirm eligibility and is not stored. If you indicate you are under 13, account creation will not be available for the remainder of that session, but you can continue using the App's local features. You agree to provide accurate information when asked. If we learn that an account belongs to someone under 13, we will delete it as described in our Privacy Policy. If you are under the age of majority in your jurisdiction, you should review these Terms with a parent or guardian.

3. Accounts
Some features require signing in (currently via Sign in with Apple). We use this to identify your account and associate it with your saved content and subscription status.
- You are responsible for maintaining the security of your device and Apple ID and for activity occurring through your account, except to the extent caused by our own failure to maintain reasonable security.
- We use automated systems (including Apple's App Attest / App Check) to verify that requests to our servers come from a genuine, unmodified copy of the App. We may block requests that fail this verification.
- You may delete your account at any time from within the App. Account deletion removes your account data, Sketchbook, Avatar, and streak/sync data from our active systems and cannot be undone once processed; as described in our Privacy Policy, copies may remain in our backups for up to 30 days before being permanently removed, and backups are not used to restore deleted accounts. Because streak-milestone app icons are tied to your current streak, deleting your account may also return your app icon to the default and re-lock milestone icons you had unlocked. Deleting your account does not automatically cancel an active Dudel Club subscription, and does not create a refund for any remaining subscription period. Subscriptions are billed by Apple independently of your account and must be canceled separately through your Apple ID subscription settings (see Section 6).
4. Your Drawings and Content
Daily Challenge. Your Daily Challenge drawing for a given day is temporary. It resets each day and is not retained by us long-term unless you save it to your Sketchbook. If you are an active Dudel Club member, your current day's Daily Challenge drawing may be uploaded to our servers automatically in the background, or when you manually choose "Sync to Device," so it can be made available on your other devices; pulling a synced drawing down onto a device always requires your explicit confirmation. This sync data is not a permanent archive and may be overwritten, deleted, or otherwise become unavailable after the relevant Daily Challenge period ends. Free (non-Club) accounts generate no sync activity from this feature.
Sketchbook (Dudel Club feature). Saving a drawing to your Sketchbook stores it on our servers under your account so it's available across your devices and app reinstalls, for as long as your account exists. Each shape has one Sketchbook slot. Once saved, a Sketchbook drawing is locked and can't be edited. You can delete a saved Sketchbook drawing at any time, which frees that shape's slot so you can draw and save a new one. Deleting a Sketchbook drawing removes it from our active systems, and it can't be recovered afterward.
Avatar (Dudel Club feature). Your avatar is stored on our servers under your account and can be changed at any time; only your most recent avatar is retained.
Streak data. Your streak is tracked separately depending on whether you're signed in. When you're signed out, your streak is stored only on your device, and deleting the App or losing your device will permanently erase it. When you first create an account, you'll be asked to choose between migrating your on-device streak to your new account or starting your account streak at zero; this choice is offered only once, at account creation, and can't be repeated later. From then on, your account streak is stored on our servers and follows your account across devices. Your on-device streak remains a separate record that isn't updated while you're signed in, so if you later sign out, the streak shown will reflect only your signed-out activity and may have reset. Streak Freeze (a Dudel Club feature) can protect your account streak from a missed day, subject to its own monthly allowance and rules described in the App.
Streak Milestone App Icons. Reaching certain streak milestones unlocks alternate app icons, available to all users. Icons are a cosmetic feature tied to your current streak: if your streak ends, your app icon returns to the default, and icons above your new streak become locked again until you reach those milestones. Unlocked icons have no monetary value, cannot be transferred, and may be changed or retired over time. Changing your app icon uses an iOS system feature, and iOS may show a confirmation message when the icon changes.
Local device data. Some data, such as in-progress, unsaved strokes on the canvas and the home screen widget's cached display, is stored locally on your device for performance and offline responsiveness. Local data may not reflect the latest cloud state at all times, and widget content is dependent on device conditions (background refresh, connectivity, and OS scheduling) and is not guaranteed to be current.
Data availability. While we take reasonable measures to protect data stored through the App, we cannot guarantee that drawings, streaks, avatars, or other content will always be available, accurate, or free from loss. To the maximum extent permitted by applicable law, we are not responsible for the loss of content resulting from device failure, service interruptions, account deletion, technical errors, or other circumstances beyond our reasonable control. Export or share anything you want to keep outside the App using the native share sheet.
Sharing. Sharing your drawing is handled by Apple's native share sheet. Any third-party apps or services you choose to share to are governed by their own terms and privacy policies; we are not responsible for how those apps handle your content once shared.
Sketchbook (Dudel Club feature). Saving a drawing to your Sketchbook stores it on our servers under your account so it's available across your devices and app reinstalls, for as long as your account exists. 5. User Conduct & Content Guidelines
You agree to use Dudel Draw only for lawful purposes and in a manner consistent with all applicable laws and regulations, and not to attempt to circumvent, disable, or interfere with security-related features of the App (including App Attest/App Check verification) or its backend services.

- be obscene, pornographic, or sexually explicit;
- depict or promote violence, self-harm, or hate speech, or target any individual or group for harassment or abuse;
- infringe any third party's copyright, trademark, or other intellectual property or privacy rights; or
- impersonate any person or entity, or otherwise be misleading in a way intended to harm others.
Because most content in the App is either local to your device or, for Sketchbook/Avatar, stored under your account and not made visible to other users, day-to-day moderation isn't part of the App's design today. That said, if we become aware of content that violates this section, including through a support request, a legal notice, or an App Store review requirement, we reserve the right to remove or disable access to that content and to suspend or terminate the associated account. If we ever introduce a feature that makes user content visible to other users, additional reporting and moderation terms will apply to that feature.
6. Dudel Club Subscription
Dudel Club is an auto-renewing subscription that unlocks Sketchbook, Avatar creation, Streak Freeze, and cross-device sync, as described in the App at the time of purchase.
Billing. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at purchase or any updated price disclosed in advance as required by Apple's guidelines and applicable law.
Managing and canceling. You can manage or cancel your subscription at any time in your Apple ID account settings (Settings > [your name] > Subscriptions on iOS). Canceling stops future renewals but does not refund the current period.
Refunds. All purchases are processed by Apple. We do not process payments or refunds directly; refund requests must be made through Apple, subject to Apple's policies and applicable law.
Price changes. We may change subscription prices from time to time. Any price change will be implemented in accordance with Apple's applicable subscription policies and applicable law, including any required advance notice or consent.
Loss of access. If your subscription lapses, Dudel Club features (including access to add new Sketchbook or Avatar saves, and new Streak Freeze use) become unavailable, but previously saved Sketchbook drawings, your existing avatar, and your streak count are not deleted solely because of a lapsed subscription, subject to the data availability provisions of these Terms and our Privacy Policy.
Subscription status and restoration. Subscription access is determined using information provided by Apple and our subscription management provider (RevenueCat). There may occasionally be a delay between a successful purchase, renewal, cancellation, or restoration and the corresponding update to your access within the App. If your subscription status appears incorrect, use the App's "Restore Purchases" feature, if available, or contact us for assistance.

Cloud infrastructure: We use Google Firebase (Authentication, Firestore, Cloud Storage, Cloud Functions, App Check, Cloud Messaging) to store account data, Sketchbook/Avatar content, and streak data, and to deliver push notifications.
Subscription management: We use RevenueCat to manage and validate Dudel Club subscription status.

8. Changes to the App; Seasonal Content
We may modify, update, suspend, or discontinue any part of the App at any time, including specific features, content, Seasons, shapes, app icons, or functionality. Where reasonably practicable, we will provide advance notice of material changes that significantly affect paid (Dudel Club) features. The App may periodically update available shapes, artwork, or seasonal content ("Seasons") via server-side configuration; Season content and availability may change over time and are not guaranteed to remain available indefinitely. Certain features may not be available in all regions, on all devices, or on all versions of iOS.
9. Experimental Features
We may occasionally offer new or experimental features, including features identified as beta, preview, or early access. These features may not work as intended, may change or be discontinued, and may have different availability or functionality than described when initially introduced. We are not obligated to continue providing any experimental feature.
10. Intellectual Property
All content and materials within the App, including graphics, logos, icons (including app icons), shape templates, and software, are the property of Silly Little Apps LLC or its licensors and are protected by United States and international copyright law. You may not reproduce, modify, distribute, or otherwise use any App content (including a shape template on its own, apart from a drawing you've made using it) without our prior written consent.
A finished Daily Challenge, Sketchbook, or Avatar drawing combines your own original artistic contributions (your strokes, coloring, and other elements you add) with one of our shape templates. You own the original artistic contributions you add. Because the finished drawing also incorporates our shape template, your ability to use and share the finished drawing is governed by the license in Section 11, rather than by unrestricted ownership of the composite image.

11. License to Your Content
To operate the App's features (such as storing, displaying, and syncing your drawings across your devices), you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit your drawings and related content solely for the purpose of providing the App's functionality to you. We do not use your drawings for any purpose beyond operating the App unless you separately agree otherwise (see our Privacy Policy). Sharing your drawing outside the App is handled by Apple's native share sheet, as described in Section 4; this license does not extend to third-party apps or services you choose to share to.
In turn, we grant you a limited, personal, non-commercial license to keep, view, and share your finished drawings, including the shape template as incorporated into that specific drawing, for your own personal, non-commercial purposes, such as saving them, viewing them in the App, or sharing them with friends and family. This license does not permit selling, licensing, publishing, or otherwise commercially exploiting a finished drawing, or any product derived from it (such as merchandise, prints, or digital goods), without our prior written permission, because doing so would commercially exploit our shape template artwork. If you're interested in using a drawing commercially, contact us. We're generally happy to discuss it.

12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE APP, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO YOU AND THE RESULTS OBTAINED THROUGH THE APP. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: (1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF INFORMATION, PRODUCTS, OR SERVICES; AND (2) ANY WARRANTIES OF TITLE, WARRANTY OF NON-INFRINGEMENT, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
13. Limitation of Liability
IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE APP OR WITH THE DELAY OR INABILITY TO USE THE APP, OR FOR ANY INFORMATION, PRODUCTS, AND SERVICES OBTAINED THROUGH THE APP, OR OTHERWISE ARISING OUT OF THE USE OF THE APP, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
Nothing in these Terms limits or excludes any liability that cannot legally be limited or excluded under applicable law.

14. Service Availability and Third-Party Outages
The App relies on internet connectivity and third-party services, including services provided by Apple, Google Firebase, and RevenueCat. We do not guarantee uninterrupted availability of the App or its features and are not responsible for interruptions caused by third-party services or events beyond our reasonable control.
15. Indemnification
You agree to indemnify and hold Silly Little Apps LLC harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the App, your violation of these Terms, or your violation of any rights of another.
16. Termination
We may suspend or terminate your access to the App or your account at our discretion, including for violation of these Terms (see Section 5). You may stop using the App and delete your account at any time as described in Section 3.
17. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in the State of Utah, except where applicable law requires otherwise.
18. Apple App Store Terms
If you downloaded the App from Apple's App Store, the following additional terms apply. These Terms are between you and Silly Little Apps LLC only, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content.
- Apple has no obligation to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
- Apple is not responsible for addressing any claims by you or a third party relating to the App or your possession/use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any claim that the App or your possession and use of it infringes a third party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- You agree to comply with any applicable third-party terms (for example, your wireless data service agreement) when using the App.
- Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
19. Changes to These Terms
We reserve the right to modify these Terms at any time. For material changes, we will make reasonable efforts to notify you in advance (such as through an in-app notice or App Store release notes) before the changes take effect. Your continued use of the App after a change takes effect constitutes your agreement to be bound by the updated Terms.
